It is unbelievable!! I was laying in my bed in extreme pain. Nearly crying. Only a week left till the surgery and I'm still not sure if I'm gonna make it that long.
Today was the child support settlement case. At 1pm I waited for the call. Nothing. Then at 1:30 I got the call. It was Mr. Jones again. He told us this was a "new" case and it was not from what they had 3 years ago. Ok...no problem (but then again I knew that). When he found out what Victor wanted to settle on , he was shock. Mr. Jones said that Vic didn't bring in his pay stubs or tax forms (why am I not surprised) so they went online to see what his income was and from what they figured, Vic should be paying $2242.00 in child support.
"What???!!!!" I was shocked. It definitly was something that I was not expecting. Maybe $750 but not $2242.00. That was way more than I had expected. Because Vic was also paying health insurance, we negotiated. I tried to bring it down to $850 but Mr. Jones said no. The courts would not accept that. I was again shocked. He also said that they for sure would not accept the $450. Really?!! (wonder why?!) So we finally settled at $1500 minus the insurance so now he has to pay $1108.50 a month. OMG!! really?! really?! REALLY?!!
Last night he said he was paying $800 for family for health insruance. So I figured with 5 of them it is about $160 a person. But he told them something different and even more than what he told me. But that is ok.
I just can't believe we won it and that we are getting much more than expected. I know Vic is not happy but he should had listened to me when I told him to bring in his stubs and tax papers and again he failed to do that. This time they didn't take his word and they looked it up and found out how much he really was making.
I have not heard back from him...may not for awhile. But even if we wanted to settle for $450, the courts would not accept it. they wouldn't even accept my $850.
So now, we are opening Tim's SPECIAL NEEDS TRUST ACCOUNT so that the money is going directly into it. I don't want to touch it. I can't. I have to make sure that it does NOT affect his SSI and his Medicaid or even food stamps. The account can not provide for his food or shelter. It can pay for medical bills not paid by medicare or medicaid and utility bills. it can pay for his other needs. So now to find the tax papers and go open it. I need to make sure the child support is directly deposit into it. I can't touch it at all.
